The way a project is procured and contracted shapes, often decisively, how risk is allocated between the parties involved — and poorly considered procurement or contract decisions can leave a client carrying risk they never intended to hold, or create the conditions for disputes further down the line. Procurement and contract risk analysis examines these decisions specifically: reviewing proposed procurement routes and contract forms for how they allocate risk, identifying contractual ambiguity or gaps that could later become the basis of a claim, and advising on risk allocation that is genuinely fair and appropriate given the nature of the project and the parties involved.
